01Information we collect

Information you give us. When you take an assessment, create an account, complete an intake, place an order, contact support or sign up for updates, we may collect:

• Name, date of birth, email, phone number, and shipping and billing addresses.
• Health information, such as height, weight, medical history, medications, allergies, symptoms, lab results, photos and intake answers.
• Identity verification information, such as a government ID or photo, when required.
• Payment information, which is processed by our payment processor. We do not store full card numbers on our servers.
• Messages, reviews and anything else you send us.

Information collected automatically. When you use the Services, we and our service providers collect device and usage information, such as IP address, approximate location, browser and device type, operating system, pages viewed, referring links and the time and date of visits.

Information from others. We may receive information from Providers, Pharmacies, labs, payment processors and shipping carriers to deliver your care and orders, and limited information from marketing or analytics partners.

If you choose not to provide information we need, we may not be able to provide the Services.

02How we use your information

We use your information to:

• Operate the Services, process orders and payments, and manage subscriptions.
• Send your intake to independent licensed Providers for review and your prescriptions to Pharmacies for dispensing and shipping.
• Track your order status, shipments and refill schedule.
• Verify identity, prevent fraud and chargebacks, and keep the Services secure.
• Respond to questions and provide customer support, including reviewing recorded support calls for quality and training.
• Send transactional messages about your account, orders, shipping and care.
• Send marketing messages where permitted, which you can opt out of at any time.
• Analyze and improve the Services.
• Comply with law, respond to legal requests, and enforce our Terms.

03Health information and HIPAA

Health Maxxers is a technology and administrative platform. The independent Providers and Pharmacies who deliver your care may be covered by the Health Insurance Portability and Accountability Act (HIPAA) and will handle your protected health information under their own HIPAA notices. Where we handle health information on their behalf, we do so under agreements that require us to protect it. We treat all health information you give us as sensitive, limit access to people who need it to deliver the Services, and use it only to provide your care, operate the Services and meet legal obligations.

We do not sell your health information, and we do not share your health information with advertising or social media companies.

04How we share information

We share personal information only as reasonably needed to provide the Services and run our business:

• Providers and Pharmacies, to review your intake, prescribe when appropriate, and dispense and ship your medication.
• Service providers who work for us, such as hosting, payment processing, lab, shipping, customer support, messaging and analytics companies. They may use your information only to perform services for us, under contract.
• Legal and safety reasons: to comply with law, a subpoena or court order, to protect the rights, property or safety of you, us or others, or to enforce our Terms.
• Professional advisors such as auditors, accountants and attorneys.
• A business transfer, such as a merger, acquisition or sale of assets, with protections requiring the buyer to honor this Notice.
• With your consent, or at your direction.

We may also share aggregated or de-identified information that cannot reasonably identify you.

SMS privacy. We do not sell, rent or share your mobile phone number or text messaging consent with third parties or affiliates for their marketing purposes. Text messaging opt-in data is used only to send the messages you agreed to receive. Reply STOP to opt out or HELP for help.

05Cookies and tracking technologies

We use cookies, pixels, tags and similar technologies to run the site, remember your preferences, understand how the site is used and measure our marketing.

• Strictly necessary: required for the site to work, such as keeping your cart and login secure.
• Performance and analytics: help us count visits and see how the site is used so we can improve it.
• Functional: remember your choices and settings.
• Advertising: measure and personalize our ads. These load only with your consent where the law requires it, and they never receive your health information, intake answers or prescription details.

You can control cookies through our cookie banner (where shown) and your browser settings. Blocking some cookies may limit site features.

Global Privacy Control. We honor Global Privacy Control (GPC) signals as a request to opt out of the sale or sharing of personal information for targeted advertising for that browser or device. Learn more at globalprivacycontrol.org.

Links to other sites. Our site may link to websites we do not control. Their privacy practices are their own.

06How long we keep information

We keep personal information only as long as needed for the purposes in this Notice, including to provide the Services, resolve disputes, prevent fraud and meet legal, tax, accounting and medical record-keeping requirements. Medical records are kept by Providers and Pharmacies for the periods required by law.

07How we protect information

We use reasonable administrative, technical and physical safeguards, including encrypted HTTPS connections across the site, cart and checkout, and access limited to people who need it. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please keep your login credentials private and contact us right away if you suspect unauthorized access.

08Children

The Services are only for adults 18 and older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has given us information, contact info@healthmaxxerus.com and we will delete it.

09Your privacy rights

Depending on your state, you may have the right to:

• Know and access the personal information we hold about you.
• Correct inaccurate information.
• Delete your information, unless we must keep it for legal, medical or regulatory reasons.
• Receive a copy of your information in a portable format.
• Opt out of the sale or sharing of personal information for targeted advertising, and of certain profiling.
• Limit the use of sensitive personal information, including health data.
• Withdraw consent you previously gave for consumer health data, where state law provides that right.
• Appeal our decision on your request.

To make a request, email info@healthmaxxerus.com. We will verify your identity before responding and respond within the time required by law. You may use an authorized agent where state law allows. We will not discriminate against you for exercising your rights.

Marketing opt-out. Unsubscribe from emails using the link in any email, and reply STOP to any text.

10Changes to this Notice

We may update this Notice from time to time. The “Last updated” date shows when it last changed. For material changes, we will post a notice on the site or contact you directly.
